Triggers for Compulsory First Registration — LRA 2002
Compulsory first registration is triggered by: (a) transfer of freehold for consideration (since 1 December 1990); (b) voluntary gift or assent of unregistered freehold; (c) creation of a legal mortgage over an unregistered freehold — buy-to-let landlords must register when remortgaging unregistered property; (d) grant of a lease over 7 years from an unregistered freehold. Application must be submitted within 2 months of the trigger event. Failure causes the legal title to revert to the transferor (LRA 2002 s.7).
Voluntary First Registration — Benefits
Voluntary first registration attracts a 25% HMLR fee discount. Benefits: (a) State guarantee of title under LRA 2002 s.58; (b) centralised title record — no risk of lost deeds; (c) simpler and cheaper future transactions; (d) LRA 2002 adverse possession regime (2-year notification) applies only to registered titles — unregistered land is more vulnerable; (e) most BTL lenders prefer registered title; voluntary registration avoids complications on future remortgaging.
Classes of Title
Absolute freehold: complete unbroken title chain; full State guarantee. Possessory freehold: based on factual possession without full documentary proof (e.g. lost deeds); State guarantee does not cover pre-registration rights; can be upgraded to absolute after 12 years. Good leasehold: leasehold title where the superior freehold cannot be verified; lenders typically require title indemnity insurance. Qualified title: specific identified defect — rare in practice.
The First Registration Process
Apply for an official search of the index map (Form SIM) to confirm the title is unregistered and to obtain a priority period. Compile all title deeds back to a good root of title at least 15 years old. Complete Form FR1 and Form DL. Submit originals (HMLR retains them). Typical timescale: 6-12 months for first registration due to complexity of examining unregistered title chains. HMLR commonly raises requisitions — prompt responses minimise delay. HMLR creates the Property, Proprietorship, and Charges registers on completion.
