HMO definition in Northern Ireland — the 3-person threshold

Under the HMO Act (NI) 2016, a property is an HMO if occupied by 3 or more persons from more than 1 household. This matches Scotland's threshold and is lower than England and Wales (5+ persons from 2+ households for mandatory HMO licensing). A property let to 3 unrelated people is an HMO in NI regardless of property size. Exemptions include: family-only occupation; resident owner-occupier sharing with up to 2 other households; purpose-built managed student halls.

Registration process with the local council

NI HMO landlords apply to the relevant 1 of 11 local councils (e.g. Belfast City Council; Newry Mourne and Down District Council). The council assesses the applicant's fit and proper person status (criminal convictions; housing management history). Registration lasts 3 years. A registration certificate is issued and must be displayed in the property. The landlord must provide a written statement to each occupant at the start of the tenancy, including the registration number, permitted occupants, and tenant rights information.

Criminal offence and council enforcement

Operating an unregistered HMO in Northern Ireland is a criminal offence under the HMO Act (NI) 2016: unlimited fine on summary conviction in the Magistrates' Court. It is a continuing offence — each day of operation without registration is a separate offence. Councils typically issue a compliance notice before prosecution. Councils can also issue improvement notices under the Housing (NI) Order 2003 for physical property defects.

NI private landlord registration — a separate obligation

All private landlords in NI (not just HMO landlords) must register at landlordregistrationni.gov.uk (administered by NIHE). This is separate from HMO registration. NI residential tenancies are governed by the Private Tenancies (NI) Order 2006 — not Housing Act 1988. RRA 2025, Section 8, and Section 21 do NOT apply in Northern Ireland. NI landlords seeking possession must use NI-specific notice and court procedures.
