HA 2004 s.254(2)(e) HMO licensing exemption for PBSA

University-owned/managed PBSA is exempt from mandatory HMO licensing under HA 2004 s.254(2)(e). Private operators can qualify where: accommodation is managed under a written university agreement; all principal occupants are that university's students (nomination agreement mechanism). PBSA marketed directly to students without university link may require mandatory HMO licensing (5+ persons, 2+ households).

Planning: PBSA is typically Use Class C2 (residential institution) or sui generis — not C3; no permitted development rights to change to C3. BCSW Code (formerly ANUK/Unipol): voluntary accreditation covering maintenance, complaints, fire safety, fair contracts; required by most universities before signing nomination agreements. Nomination agreements: university guarantees to fill a set proportion of beds; operator provides housing for nominated students; management standards are contractually required.
