Does the Renters' Rights Act 2025 apply in East Kilbride?
No. The Renters' Rights Act 2025 (RRA 2025), which abolished Section 21 and new fixed-term tenancies in England from 1 May 2026, applies only in England. Private landlords in East Kilbride and throughout Scotland operate under the Private Residential Tenancy (PRT) framework introduced by the Private Housing (Tenancies) (Scotland) Act 2016. Scottish tenancies have been fully periodic from the outset since 1 December 2017; Section 21 was never available in Scotland; and Scottish landlords serve a 'notice to leave' specifying one of the 18 statutory grounds rather than an English-style Section 21 or Section 8 notice.
Is Scottish Landlord Registration required before renting in East Kilbride?
Yes. All private landlords in Scotland must register with the local authority (South Lanarkshire Council in East Kilbride's case) via the national register at register.landlord.gov.scot before advertising or letting any residential property. You must register yourself as a landlord and register each rental property. Registration must be renewed every 3 years. Unregistered landlords may face enforcement action; tenants can also apply for Rent Payment Orders, directing rent to be paid to South Lanarkshire Council rather than the landlord, until registration is obtained.
